There are many OSHA standards which expressly incorporate industry guidance documents and many other OSHA standards which set forth vague and subjective requirements. The operative terms in these standards are words such as ?adequate? or ?appropriate.? OSHA uses industry guidance documents to explain and then enforce these terms. This presentation will discuss the legal issues associated with OSHA enforcement of these terms and associated with adhering to industry standards as they evolve.
