(192a) Things You Should Know to be an Effective Expert Witness in an Intellectual Property (IP) Matter in the Chemical Processing Industry

Serving effectively as an expert witness in an IP dispute requires the expert witness to be knowledgable about terminology, legal process, and expectations of their role in prosecuting infringement or disputing the validity of a patent. The author has supported over twenty-five IP litigations since 2008, experience that permits him to offer insights from the perspective of the expert. This talk will discuss, (1) the role of an expert witness in a litigation (in general); (2) terminology specific to an IP matter (including Inter Partes Review, claims construction, person of skill in the art, discovery, prior art, infringement, considerations for obviousness, unenforceability, and trade secret); and finally, (3) the stages of the IP litigation process and expected/typical timelines of each.
