This presentation will address the existing environmental regulatory structure designed to encourage environmental regulatory compliance through discovery of violations and self-reporting. Specifically, the presenter will summarize the elements and purpose of EPA's Audit Policy and how the policy works from a practical perspective. The presenter will discuss how penalties are assessed in situations where self-reporting takes place pursuant to EPA audit policy as well as the critical role the attorney client privilege can play in the process. Finally, operational and process tips will be offered.
